Terms of Service

1. Agreement to Terms

By accessing or using BloomChat ("the Service"), operated by BloomChat Technologies ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

BloomChat is an AI-powered creator management platform that helps content creators manage their online presence and interactions on Fanvue. The Service provides content scheduling, AI-assisted messaging, subscriber management, automated direct message drafting, pay-per-view (PPV) campaigns, analytics tools, and automated re-engagement workflows.

3. Eligibility

You must be at least 18 years old to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.

5. Platform Connections

BloomChat connects to Fanvue via official API mechanisms and secure OAuth 2.0 authentication. We never ask for or store your raw platform passwords. You authorise access through Fanvue's secure consent flow and may revoke access at any time through your account settings on Fanvue or within BloomChat.

6. Acceptable Use

You retain ownership of all content you create or manage through the Service. You are solely responsible for ensuring your content complies with Fanvue's terms and all applicable laws.

You agree not to use the Service to:

  • Distribute illegal content or content involving minors.
  • Harass, threaten, or harm others.
  • Circumvent platform rules, rate limits, or API terms.
  • Impersonate others or misrepresent your identity.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Use automated means to create accounts or circumvent usage limits.
  • Engage in any activity that violates applicable laws or regulations.

7. AI Features and Generated Content

The Service uses AI models to generate message drafts, captions, PPV pitches, and engagement insights. AI-generated content is provided as suggestions only. You are solely responsible for reviewing, editing, and approving all content before publication or delivery to subscribers.

We do not guarantee the accuracy, appropriateness, or quality of AI-generated content. All AI outputs pass through safety filters, but you remain the final decision-maker.

8. Intellectual Property

You retain all rights to your original content. By using the Service, you grant us a limited licence to process, store, and transmit your content solely for the purpose of providing the Service.

BloomChat, its design, features, and underlying technology are the intellectual property of BloomChat Technologies. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Subscription and Billing

Certain features require a paid subscription. Pricing, billing cycles, and cancellation terms are displayed at the time of purchase. Free-tier users receive access to core features with monthly messaging caps. Paid plans unlock higher limits, advanced AI models, and premium automation. Refunds are handled in accordance with our billing policy and applicable consumer protection laws.

10. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

11. Service Availability

We aim to provide reliable, uninterrupted service but do not guarantee 100% uptime. We may perform maintenance, deploy updates, or make modifications that temporarily affect access. We will endeavour to provide advance notice of planned downtime. We are not liable for losses arising from service interruptions, Fanvue platform outages, or force majeure events.

12. Limitation of Liability

To the maximum extent permitted by law, BloomChat and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, platform account standing, or business opportunities.
